StallTap Terms of Service

StallTap is a product and service operated by EZ Live Productions LLC ("StallTap," "we," "us," or "our"), a company registered at 5528 Blue Heron Dr, Bonanza, OR 97623. These Terms of Service ("Terms") govern your access to and use of the StallTap website, mobile-facing pages, NFC hardware products, and related services (collectively, the "Service").
By purchasing a StallTap product, creating an account, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
StallTap provides physical NFC ("tap") tags that link to an online digital profile page for a horse, including photos, video, pedigree, sale/hip information, and related links (e.g., a bidding or contact link). We also provide the account tools, dashboard, and hosting used to create and manage those pages.
2. Accounts
To manage a horse's page, you create an account using an email address and PIN. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.
You must provide accurate information when creating an account or placing an order. We may suspend or terminate accounts that provide false or misleading information.
3. Orders, Payment, and Fulfillment
Prices for StallTap products are as displayed at checkout. Payment is processed securely through Stripe, Inc. ("Stripe"); StallTap does not collect or store your full payment card number (see our Privacy Policy).
Physical products (NFC tags/cards) are fulfilled through StallTap or a third-party fulfillment partner. Delivery timeframes are estimates only and are not guaranteed. Risk of loss for physical products passes to you upon delivery to the shipping carrier.
Refunds, exchanges, and hardware replacements are governed by our separate Refund Policy, which is incorporated into these Terms by reference.
4. Your Content
When you upload photos, video, descriptions, pedigree information, or other material ("Your Content") to a horse's page, you retain ownership of it. You grant StallTap a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and transmit Your Content solely for the purpose of operating and providing the Service (including displaying the public horse page to anyone who taps or visits it).
You are solely responsible for Your Content. You represent that you own or have the necessary rights to Your Content, and that it does not infringe any third party's rights or violate any law. We may remove any content that we believe, in our discretion, violates these Terms.
5. Accuracy of Listings
StallTap is a presentation and hosting tool. We do not verify the accuracy of pedigree information, hip numbers, sale details, or any other information you post, and we are not a party to any sale, purchase, or bid transaction that may occur as a result of a StallTap page. Any bidding links, contact links, or sale information are provided by you and are your sole responsibility.
6. Acceptable Use
You agree not to use the Service to:
- Post false, fraudulent, or misleading information about a horse or sale;
- Upload content that is unlawful, infringing, obscene, or that violates the rights of others;
- Attempt to interfere with, disrupt, or gain unauthorized access to the Service, other accounts, or our systems;
- Use the Service for any purpose other than presenting horses for sale or exhibition as intended.
We may suspend or terminate access for any violation of this section.
7. Hardware
StallTap NFC tags/cards are physical products subject to normal wear. See our Refund Policy for what happens if a tag arrives inoperative or fails.
8. Intellectual Property
The StallTap name, logo, website, software, and platform (excluding Your Content) are the property of EZ Live Productions LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
9. Disclaimers
THE SERVICE AND ANY PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY HORSE LISTING WILL RESULT IN A SALE OR ANY PARTICULAR OUTCOME.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZ LIVE PRODUCTIONS LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO STALLTAP IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless EZ Live Productions LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination (including Sections 4, 8–11) will survive.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Effective Date" above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Oregon.
